GENERAL

This is a digital good. There are no physically shipped goods to receive.

Client will receive the full-resolution image via VGen platform or e-mail.

Client confirm that they are of legal age or have a parent or responsible permission to purchase the commission.

Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.

Client warrants that the character design and reference material provided to the Artist are legally obtained and authorized for use by the Client.

Artist reserves the right to refuse projects or requests based on content, subject, or other reasons.

PAYMENT

Payment can be received through VGen, which accepts PayPal, credit card and debit card.

If the request is not via VGen, payment will be through PayPal invoice.

Once your commission is accepted, I’ll be in contact with you to confirm the final prices, and then send you an invoice.

Full payment is required upfront.

Prices may vary or change depending on complexity, requirements and/or additional requests.

Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work.

Clients must not send money before these requests for payment from the Artist.

Invoices must be paid within 72 hours (3 days), or the project may be canceled.

REVISIONS

Artist provides progress updates and seeks Client feedback voluntarily.

Complete redo of a commission after the sketch approval are not allowed.

After line art, only minor revisions are allowed.

Additional charges for excessive revisions may be required.

If the Artist forgets a detail from the character, no charges are applied.

Revisions may affect progress and timeline.

COMMUNICATION

Ongoing communication and discussion will occur throughout the project, including but not limited to work in progress, idea generation and collaboration, situational updates, and more.

Communication channels may include Discord, Twitter private messages, Trello, or others according to Artist discretion.

Artist response time may vary, up to one week in order to provide better or more concrete updates.

TIMELINE AND PROCESS

Work completion requires 2 weeks minimum, and may take up to 3 months depending on each project.

Timeline depends on commission type, complexity, and workload.

Final deliverables are provided by the Artist using the VGen platform, Google Drive or similar file transfer tools.

If there are any delays and adjustments to timeline, the Artist will inform the Client.

Clients must first agree to delays and amendments to timeline exceeding 3 months through standard communication channels.

RIGHTS & USE

Artist Rights

The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more, unless stated otherwise with additional fees.

Client Rights

Clients receive exclusive, non-transferable usage rights to the Work for personal use.

Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.

Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.

Client must not edit or modify Work in any way without prior permission from the Artist.

Commercial Rights

Additional charges will be required for commercial usage (+$100 to the original cost).

Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites or as agreed upon.

Commercial rights means usage of Work on streams or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.

Usage of Work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.

General Rights

Except by the Client and any authorized personnel, the Artist's Work must not be reposted or used in any capacity by any other party without express written permission.

CANCELLATION AND REFUND POLICY

No refunds are possible after work begins unless initiated by the Artist.

Clients have the right to request refunds 3 months after deadlines if Work has not been delivered and there was no agreed upon amendment to the timeline. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund only.

Service and payment processing fees (VGen and PayPal fees) are not returned when issuing a full refund.

PAGAMENTO

Os valores estão em Reais (R$ / BRL).

Pagamento pode ser por Pix, Picpay ou Transferência Bancária.

Quando seu pedido for aceito, eu entrarei em contato para confirmar os valores finais e mandar as informações para o pagamento.

O pagamento total é exigido antecipadamente. Eu só irei iniciar o desenho após confirmação do pagamento.

PROCESSO E ENTREGA

O tempo para finalizar a encomenda pode levar de uma semana até dois meses.

Eu irei mandar screenshots durante várias partes do processo para aprovação de maiores detalhes.

Não é permitido o refazer completo do desenho após a aprovação do rascunho.

Você receberá o desenho finalizado em resolução máxima como .PNG por e-mail.

COPYRIGHT E USO

A arte é apenas para uso pessoal e não se destina ao uso comercial ou revenda.

Você pode publicar sua encomenda em sua própria rede social. Pode usar, imprimir ou recortar sua arte comprada para uso privado sem fins lucrativos, como banners de mídia social, ícones, planos de fundo, impressões de arte física ou adesivos físicos.

Você NÃO pode alterar a arte encomendada sem o meu consentimento.

Você não tem permissão, sob nenhuma circunstância, de usar qualquer parte de sua comissão final para tokens não fungíveis (NFT). O uso de minha arte para qualquer publicidade ou lucro associado a tokens não fungíveis, blockchains ou criptomoeda é estritamente proibido.

Eu tenho o direito de publicar a sua encomenda em minhas redes sociais e portfolio, em baixa resolução e com marca d'água. Você pode pedir que a sua encomenda não seja postada, mas deve pedir com antecedência.

CANCELAMENTO E POLÍTICA DE REEMBOLSO

Eu posso cancelar a encomenda a qualquer momento por motivos como: conflito de interesses ou circunstância pessoal. Nesses casos, você será reembolsado.

Não faço reembolsos, apenas em casos extremos, e apenas se o desenho ainda não tiver sido iniciado.
